EU-U.S. Privacy Shield Framework
HyTrust is subject to the regulatory and enforcement of the US Federal Trade Commission (FTC)
HyTrust develops and sells security and infrastructure software solutions to business customers. We receive mostly business-related information from Europe, but also contact information related to individual representatives of customers, distributors, resellers, and other business partners. For example, HyTrust may collect names, job titles, addresses, work phone numbers, work email addresses in connection with commercial and corporate transactions and other business relationships. Some of our customers may not be incorporated and may provide their home address when they acquire software licenses from our authorized partners or when they sign-up for support services.
HyTrust collects and uses personal data for purposes of providing products and services to our customers, communicating with corporate business partners about business matters, providing information on our products and services and conducting related tasks for legitimate business purposes and corporate development opportunities.
HyTrust may share personal data to service providers and other contractors acting as our agents, for the purpose of performing business related functions and services such as offering or providing technical or operational support to our prospects or customers and their authorized users and support for the use of our product, who may process such data on our behalf and subject to confidentiality restrictions. If you do not want us to share your personal information with these companies, contact us at firstname.lastname@example.org. HyTrust may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.
If personal data covered by this Privacy Shield Policy is to be used for a new purpose that is materially different from that for which the personal data was originally collected or subsequently authorized, or is to be disclosed to a non-agent third party, HyTrust will provide you with an opportunity to choose whether to have your personal data so used or disclosed. To the extent required by the Privacy Shield Principles, HyTrust will obtain an opt-in consent for certain uses and disclosures of sensitive data.
Recipients of marketing e-mails may opt-out of receiving further e-mail marketing communications from HyTrust by following opt-out instructions that are contained in each marketing e-mail. HyTrust acknowledges the right of individuals to access their personal data. Residents of the EU or Switzerland whose personal data HyTrust has directly collected may request access to, and the opportunity to correct, amend, or delete such personal data. To submit such requests or raise any other questions, please contact us at email@example.com. HyTrust reserves the right to take appropriate steps to authenticate an applicant’s identity, charge a reasonable fee before providing access and deny requests, except as required by the Privacy Shield principles.
HyTrust remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless HyTrust proves that it is not responsible for the event giving rise to the damage.
HyTrust has further committed to refer unresolved privacy complaints under the EU-US and Swiss-US Privacy Shield Principles BBB EU PRIVACY SHIELD, operated by the Council of Better Business Bureaus. Finally as a last resort and in limited circumstances EU and Swiss individuals with unresolved complaints can invoke a binding arbitration option before a Privacy Shield Panel.
